Contract Break-Down
General Contract for Photography Services
-Payment-
All sessions and packages (plus taxes) may be paid by client via cash (as approved by photographer), check, Visa, or MasterCard via invoice, Cash app, or PayPal. If a client pays by check, the check must clear before session will be considered “booked” and any uncleared check will have an additional charge of $35 to cover bank fees. The remainder at this time must be paid.
Payment is due by the end of the session, no exceptions. If you want to create a payment plan, it must be set up prior to the session and approved by Chicago Street Portraits, LLC. We accept cash or check, or you can pay your invoice directly with a credit card (there is a 3% credit card transaction fee for the credit card option.) If payment is not received in full within 10 days after the session date, a reoccurring late fee of $25.00 will be billed each month until the invoice is paid in full. This can go on for five consecutive months. On the 181st day after your session, if the invoice is still not paid in full, the photos will go into the vault and there will be an additional $500 fee to get them out in addition to the remaining balance and all late fees accrued. No images will be given until the invoice is paid in full.
-Non-Refundable Retainer-
For all portrait sessions, a non-refundable session retainer is required to book and hold the date for your session and serves as a cancellation fee. However, the fee can be credited towards a future session upon the photographer’s approval. All remaining balances are due at the time of the session.
For wedding packages, a 50% non-refundable retainer is due immediately to book and hold the date of your event and serves as a cancellation fee. The remaining 50% balance is due two (2) weeks before the date of the wedding. You can break this up into multiple payments if needed.
-Cancellation/Rescheduling Policy-
For portrait sessions, client forfeits their session retainer paid to book the session. As previously stated, the fee can be credited towards a future session if the client reschedules the appointment by calling 48 hours prior to the date of the session and re-booking at an agreeable date and time.
FOR WEDDING AND EVENTS: If for any reason the Client cancels before the wedding date, the Photographer will keep the event retainer fee paid to hold the wedding or event date as a cancellation fee. Cancellations must be made and sent in writing, by mail or e-mail. However, if the client requires us to change the wedding date, I will do my best to accommodate the change and no fee will be charged if the new date is available and within five months of the original event date. If I am not available for the new date, the original agreement will be cancelled and subject to the cancellation policy.
If Chicago Street Portraits, LLC cannot perform this photo session due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return the retainer fee to the Client but shall have no further liability with respect to the agreement. This limitation on liability shall also apply if photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.
INCLEMENT WEATHER: Chicago Street Portraits, LLC will reschedule sessions at the discretion of the client or photographer if the appointment day or time booked ends up being a day that it is raining, snowing, sleeting, hailing, super cold or hot, or for any other unfavorable inclement weather condition that presents itself. We typically use the following Wednesday after the session or another day and time that works for both the Client and Chicago Street Portraits, LLC to reschedule within 2 weeks from the original appointment. There are times when light snow or light rain can be beautiful for pictures, and in these cases, we can discuss if that would be an option for your session.
TRAVEL POLICY: Chicago Street Portraits, LLC will travel up to one hundred miles round trip as a part of the session fee. Any location that is over one hundred miles round trip from Quincy MI 49082, is subject to a $45.00 travel fee plus $.62 per mile, up to 250 miles total roundtrip. Anything over 250 miles round trip is subject to being classified as a destination wedding.
DESTINATION WEDDINGS: We will travel over 250 miles roundtrip for destination weddings. Please reach out for a customized quote if you are interested in this option.
LOCATIONS FOR SESSIONS: Once the appointment is booked, and the deposit paid, we will email you a location list of over 5 + potential locations to choose from that are within our travel area. If you have a different location in mind that you would like to use for your session, that is no problem.
-Refund Policy-
In the case of camera failure, inclement weather, or any other unforeseen incident that prevents CHICAGO STREET PORTRAITS, LLC from shooting on a scheduled date a new date will be scheduled, or client will be refund of their deposit, if applicable.
No refund will be given under any circumstances if you fail to attend the activity on the day and at the time listed when the booking was made.
Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned; CHICAGO STREET PORTRAITS, LLC has a strict NO REFUNDS POLICY. Once a transaction has been completed (i.e., the buyer selected and paid for the photo and then CHICAGO STREET PORTRAITS, LLC sent the buyer the correct photograph) it is then considered non-refundable. If a buyer has selected and purchased an incorrect photo, he/she must notify CHICAGO STREET PORTRAITS, LLC, before receiving the “incorrect” photograph.
Refunds will NOT be given due to “not liking a photo,” selecting an incorrect photo after the buyer has already received the photograph, or any other reason. If a mistaken photo is sent to the buyer, as documented on the invoice, CHICAGO STREET PORTRAITS, LLC will send the correct photo to the buyer free of charge.

-Model Release-
I hereby give permission to Chicago Street Portraits, LLC to use my photos and likeness in all forms and media for advertising, portfolio, demo, trade, stock photography, editorial, altering without restrictions, and all other lawful purposes. I understand I am entitled to no compensation. I release the photographer of all forms of claims and liability related to my photo usage. I am over 18 years of age, and I fully understand the terms of this release.
Model Release for a Minor Child
In consideration of the engagement as a model of the minor child named below and for other good and valuable consideration, I hereby grant to Chicago Street Portraits, LLC, and their heirs, successors and assigns (hereinafter the "Photographer"), the irrevocable, perpetual and unrestricted right and permission to take still and moving photographs, portraits and pictures of said minor child (the Photographs”). I hereby grant to the Photographer and those claiming under her and for whom the Photographer is acting, the unrestricted right to use, publish, transmit, display, and license the Photographs in which the child may be included in whole or in part. I authorize the Photographer to use the Photographs in composite or in distorted character or form, in conjunction with the child’s own or a fictitious name in any and all media now known or hereafter developed, invented or discovered including but not limited to all print, digital, Internet, social media and broadcast media for all purposes whatsoever including illustration, promotion, art, editorial, advertising and trade.
I also consent to the digital manipulation or distortion of the Photographs, including without restriction any changes or alterations as to color, size, shape, perspective, context, foreground, and background. I further consent to the use of any published matter in conjunction with the Photographs. I waive any rights that I or the child may have to inspect or approve the finished product or products and any advertising copy or other matter that may be used in connection with the Photographs or the use to which they may be applied.
I hereby warrant that I am the parent or legal guardian of the child and that I have full permission and authority to sign this Model Release on behalf of the minor child. This release shall be binding upon the minor child and me, and our respective heirs, legal representatives, successors, and assigns.
-Altering Images & Social Media Use-
Client understands that photographer holds all copywrites to images and client may NOT alter the images in any way including the use of social media filters. Any images by Chicago Street Portraits, LLC posted on social media MUST have a photographer’s credit viewable.
-Commercial Usage Release –
Commercial usage of images taken by Chicago Street Portraits, LLC must first have written permission by photographer OR copyrights may be purchased at an additional cost. Clients who use my images for financial gain without first purchasing a commercial usage package will be subject to litigation as applicable by state law. The client will be responsible for any fees incurred including but not limited to- attorney’s fees, court costs, restitution, and royalties. Please let me know if you need commercial usage for your images.
-Client Acknowledgement of policies and procedures
Client acknowledges they have read this contract in its’ entirety and agree to the terms and conditions set forth herein. Client has read and understands all cancellation/reschedule/refunding policies.
FAQ
Q: How long will my pictures take?
A: After our session, my delivery time generally takes 3-10 business days.
Q: Can I use my own photo lab for prints?
A: Of course! I provide all clients with a print release which grants the use of personal and commercial printing labs. However, clients may also order prints directly from their gallery after logging into the client portal!
